An Act relative to boating on Webster Lake.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Notwithstanding the provisions of section 45 of chapter 131 of the General Laws or any other general or special law to the contrary, the town of Webster shall be authorized to adopt and amend municipal rules and regulations relative to the size and operation of boats utilized for commercial trade on Webster Lake located in the town of Webster.

The term “commercial trade” as used in this act shall include any boat carrying passengers for hire.

Any such rule or regulation, or amendment to be adopted by the town of Webster under this act shall be first submitted for acceptance by the registered voters of said town by majority vote at an annual election, to be placed on the ballot upon petition to the town’s clerk by its board of selectmen. 

Such rule or regulation, or amendment to be adopted by the town of Webster, shall prior to taking effect, be subject to the approval by the commissioner of the department of environmental protection.

This act shall not prevent the department of environmental protection from adopting rules or regulations, or amending the same, relating to boating on Webster Lake, which shall be controlling with respect to any conflicting municipal rule or regulation.
