By Representative Naughton of Clinton and Senator Chandler, a joint petition (accompanied by bill, House, No. 4507) of Harold P. Naughton, Jr., Harriette L. Chandler and Jennifer L. Flanagan (by vote of the town) that the board of selectmen of the town of Clinton be authorized to appoint the town collector for said town.  Municipalities and Regional Government.  [Local Approval Received.]

An Act authorizing the board of selectmen of the town of Clinton to appoint the town collector.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Notwithstanding chapter 41 of the General Laws or any other general or special law or by-law to the contrary, the office of town collector in the town of Clinton shall be appointed by the board of selectmen.  The town collector shall be governed by the town of Clinton personnel by-laws and shall have all the powers, perform all duties and be subject to the liabilities and penalties conferred and imposed on town collectors by law.

SECTION 2.  Notwithstanding section 1, upon the effective date of this act, the position of elected town collector shall be abolished and the term of the officer holding the office of town collector shall be terminated.  The elected incumbent holding the office at the time of termination shall become the first appointed collector and shall serve in that capacity for a period of time equivalent to the remainder of the incumbent’s elected term or sooner resignation or retirement.  Thereafter, appointments to the position of town collector shall be made in accordance with said section 1.

SECTION 3. This act shall take effect upon its passage.
