An Act authorizing the Massachusetts Water Resources Authority to release an easement upon certain real property in the city of Quincy.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.Notwithstanding any other general or special law to the contrary, but subject to subsection (d) of section 9 of chapter 372 of the acts of 1984, the Massachusetts Water Resources Authority may release an easement on a certain parcel of land in the City of Quincy owned by Quincy Shipyard, LLC. The easement is located on a parcel situated on the southerly side of South Street in the City of Quincy and is more particularly bounded and described as follows:

Beginning at a point on property line dividing land now or formerly of Quincy Shipyard LLC and Fall River Marine Terminal LLC, said point bearing S17°18’20”E a distance of sixty two and forty hundredths (62.40) feet from the most northerly corner of said land now or formerly of Fall River Marine Terminal LLC; thence

N17°18'20"Wby said land now or formerly of Fall River Marine Terminal LLC on said line a distance of twenty four and one hundredth (24.01) feet to a point; thence

N39°05'39"Edistance of thirty one and seventy four hundredths (31.74) feet to a point; thence

Northeasterlycurving to the right along the arc of a curve having a radius of one hundred seventy and no hundredths (170.00) feet, an arc length of forty one and three hundredths (41.03) feet to a point; thence

N52°55'18"Ea distance of nine and seventy nine hundredths (9.79) feet to a point; thence

Northeasterlycurving to the right along the arc of a curve having a radius of three hundred twenty and no hundredths (320.00) feet, an arc length of one hundred thirty eight and eighty two hundredths (138.82) feet to a point; thence

N77°46'38"Ea distance of eighty and twenty eight hundredths (80.28) feet to a point; thence

Easterly curving to the left along the arc of a curve having a radius of three hundred and no hundredths (300.00) feet, an arc length of seventy six and five hundredths (76.05) feet to a point at a twenty (20) foot wide Railroad Easement referenced herewith; thence

S63°15'10"Wover and across aforesaid land by a twenty (20) foot wide Railroad Easement referenced in a plan entitled “Subdivision Plan of Land, Lot 7 – Fore River Shipyard” in Quincy, Mass., prepared by BSC Group, Inc. dated January 9, 2002 and last revised on April 25, 2002., a distance of one hundred seventeen and ninety eight hundredths (117.98) feet to a point; thence

S77°46'38"Wa distance of forty one and thirty two hundredths (41.32) feet to a point; thence

Southwesterlycurving to the left along the arc of a curve having a radius of three hundred and no hundredths (300.00) feet, an arc length of one hundred thirty and fourteen hundredths (130.14) feet to a point; thence

S52°55'18"Wa distance of nine and seventy nine hundredths (9.79) feet to a point; thence

Southwesterlycurving to the left along the arc of a curve having a radius of one hundred fifty and no hundredths (150.00) feet, an arc length of thirty six and twenty hundredths (36.20) feet to a point; thence

S39°05'39"Wa distance of forty five and three hundredths (45.03) feet to the point of beginning, the previous twelve (12) courses and distances over and across said land now or formerly of Quincy Shipyard LLC.

The above described parcel of land contains an area of 6,085 Square Feet, more or less, or 0.140 acres, more or less, and is more particularly shown as Area “D” on a plan entitled “Plan of Land, South Street in Quincy Massachusetts (Norfolk County) Fore River Shipyard,” dated June 27, 2014 and prepared by BSC Group, Inc. to be recorded with the release of easement.

SECTION 2.As consideration for the release of easement authorized in Section 1, Quincy Shipyard, LLC will convey a permanent right and easement to the Massachusetts Water Resources Authority for the Massachusetts Water Resources Authority and/or Fore River Railroad Corporation (a Massachusetts corporation being wholly owned by Massachusetts Water Resources Authority) containing an area of 5,872 square feet, more or less, or 0.135 acres, more or less, on a parcel situated on the southerly side of South Street in the City of Quincy and is more particularly shown as easement “E” on a plan entitled “Plan of Land, South Street in Quincy Massachusetts (Norfolk County) Fore River Shipyard,” dated June 27, 2014 and prepared by BSC Group, Inc. to be recorded with the grant of easement.
