To the Honorable Senate and House of Representatives,

 

Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution as amended by the Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Validating the State Election Held on November 4, 2014”.

Senator Wolf, Representative Madden and the Chilmark Board of Selectmen have requested that I file this legislation on behalf of the Town. The purpose of this legislation is to ratify a bond authorization of the Town passed on November 4, 2014, to the same extent as if there were no deficiencies in the notice relating to the vote of the Town. Because of the deficiencies in the notice, the election law requirements were not completely met.

The Town and bill sponsors are confident that the Town residents did receive adequate notice of the bond authorization through a variety of channels, including a vote at a special Town Meeting.

Message from His Excellency the Governor recommending legislation relative to validating the state election held on November 4, 2014 in the town of Chilmark.

In the Year Two Thousand Fourteen

An Act Validating the results of a certain election held in the town of Chilmark.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to enable the Town of Chilmark to reconstruct, pave and make various repairs to Town roads, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Notwithstanding any defect in the notice given by the Town of Chilmark regarding Question 5 of the State Election ballot, which was approved by the voters of the Town of Chilmark on November 4, 2014, and notwithstanding any general or special law, charter provision or Town by-law to the contrary, the approval of Question 5 by the Town of Chilmark at the State Election held on November 4, 2014 is hereby ratified, validated, approved and confirmed in all respects.

SECTION 2. This act shall take effect immediately upon its passage.
