An Act relative to teacher compensation in regional school districts.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to facilitate school district regionalization, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 42B of chapter 71 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by striking paragraphs one through four, and inserting in place thereof the following two paragraphs:-

Any school personnel who have professional teacher status or other rights under section 41 in a particular school district whose positions are superseded by reason of the establishment and operation of a regional school district shall be employed with the same status by the regional school district; provided, however, that there is an available position which the person is certified to fill. All school personnel without this status in the district whose positions are superseded by reason of the establishment and operation of a regional school district shall be elected to serve in that district by the regional school district committee; provided, however, that there is an available position which the person is certified to fill.

All personnel employed by a regional school district, whether newly created or created through an expansion or consolidation of existing regional school districts, shall be paid at not less than the rate received by the school personnel immediately prior to the person’s employment by the newly created, expanded or consolidated regional school district. That pay shall remain in effect until the regional school district committee and the appropriate exclusive bargaining representative for regional school district employees approve a successor to the collective bargaining agreement or agreements previously negotiated by the preceding school or regional school district committees. Nothing herein shall be construed to require an increase in pay prior to the successor agreement. In any newly created, expanded, or consolidated regional school district, the bargaining unit structure and questions concerning representation, if any, shall be determined under chapter 150E. All other terms and conditions of employment for personnel whose positions are superseded by reason of the establishment and operation of a regional school district shall be subject to chapter 150E. Personnel shall be given credit by the regional school district committee for all accumulated sick leave, accumulated time towards service, accumulated years of service for sabbatical leave and accumulated time for terminal compensation due the school personnel on the termination of service.
