An Act to ensure appropriate regulation of piggeries.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 143 of chapter 111 of the General Laws is hereby amended by inserting after the last sentence:-

“However, no piggery shall be prohibited or closed absent any significant and persistent impact on air or water quality, or reasonable cause to believe that such impacts will occur. In determining whether piggeries or proposed piggeries pose or may pose significant and persistent impacts,  boards shall rely on guidance and standards produced by the USDA Natural Resources Conservation Service or other appropriate guidance and standards as identified by the Department of Agricultural Resources.”
