An Act relative to sidewalk safety.
Whereas, The deferred operation of this act would tend to defeat its purpose, which is to increase pedestrian safety on boulevard sidewalks, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public safety.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 36 of chapter 92 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after the word “boulevard”, in line 10, the following words:- ; provided, however, that the commonwealth shall be liable for injuries sustained upon a negligently maintained sidewalk of a boulevard.
SECTION 2. Said chapter 92 is hereby further amended by inserting after section 42 the following section:-
Section 42A. The division shall illuminate, or have illuminated, traffic circles, traffic underpasses, traffic overpasses, traffic islands and other locations on any boulevard maintained by the division, wherever, in its reasonable judgment, the illumination is necessary for the safety of the travelling public both on the boulevard and on any adjacent sidewalk.
