An Act relative to insurance coverage for homeowner heating safety and remediation of oil spills.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Paragraph (b) of Section 4D of chapter 175 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by inserting after the word “occurrence” in line 14, the following words: - or the policy’s personal liability limit, whichever is greater
SECTION 2. Paragraph (b) of Section 4D of chapter 175 of the General Laws, as so appearing, is hereby further amended by inserting after the word “applicable” in line 28, the following sentence:- No insurers shall be allowed to exclude said first-party and third-party liability coverage arising out of the release of heating oil under the liability coverage provisions of a homeowner’s insurance policy.
