An Act waiving bank fees for the disabled.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 2 of chapter 167D of the General Laws, as appearing in the 2010 official edition, is hereby amended by inserting, in line 11, after the words, “age or older” the following words:- or a handicapped person as defined in subsection 17 of section 1 of chapter 151B.

SECTION 2. Said section 2 of said chapter 167D is further amended, in line 26, by inserting after the words “or older” the following words:- or is a handicapped person as defined in said subsection 17 of said section 1 of said chapter 151B.

SECTION 3. Said section 2 of said chapter 167D is further amended, in line 27, by inserting after the words “in a form acceptable to the bank.”  the following sentences:- A handicapped consumer shall notify the bank of his eligibility for such account and confirm such handicap by providing a signed letter written by the individual’s physician. The disclosure of this letter by the bank to any persons other than the individual or his guardian and the commissioner of banks or his examiners under section 2 of chapter 167, is prohibited.

SECTION 4. Said section 2 of said chapter 167D is further amended, in line 40, by inserting after the words “age or older.” the following words:- ,or a handicapped person as defined in said subsection 17 of said section 1 of said chapter 151B.
