An Act relative to interchangeable drug products.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 12D of chapter 112 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after the word “section”, in line 1, the following words:- and section 12D½.

SECTION 2. Said chapter 112 is hereby amended by inserting after section 12D the following section:-

Section 12D½. (a) Upon the issuance of a prescription, the practitioner, or an agent thereof, shall provide the patient with a list of the interchangeable drug products  that correspond to the drug being prescribed and are included in the most current formulary, or revision thereto, prepared by the drug formulary commission pursuant to section 13 of chapter 17.

(b) A patient may inform the director of consumer affairs and business regulation in the event that a practitioner fails to comply with subsection (b). The director shall refer the matter to the board of registration in medicine for appropriate action.
