Subsection (b) of section 25 of chapter 270 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by adding the following paragraph:-
This section shall not apply to persons under the age of 17 who are employed by an ice cream truck vending company with 5 or more employees; provided that (i) said minor employee is under the direct supervision of an adult employee who has been issued a valid permit under this section and who is present at the same physical location as the minor employee for the duration of all of the minor employee’s working hours; (ii) minor applicants under the age of 17 are required to self-report any felony convictions for 10 years following the date of disposition or release from incarceration, whichever is later; and (iii) the ice cream truck vending company shall make reasonable efforts to ensure that its minor applicants and employees are not sex offenders, as defined by section 178C of chapter 6 of the General Laws, including without limitation, checking to see whether any minor applicant or employee is listed on the sex offender registry maintained by the sex offender registry board.
