Amendment #79 to H.3382

Lifecycle planning

Mr. Straus of Mattapoisett move that the bill be amended by adding the following section at the end thereof:



SECTION XX. (a) Section 34 of chapter 6C of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by deleting, in lines 1-3, the words “a transportation infrastructure project, including mass transit expansion or the construction of new roadways with a projected capital cost of more than $15,000,000” and inserting in place thereof the following words:-



any capital project.



(b) Chapter 161A of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after section 3 the following section:-



Section 3A. Prior to the final approval of any capital project, and prior to expending any funds for the planning, design and construction of any such project, the authority shall prepare a fiscal analysis, including life cycle costs, demonstrating that sufficient revenues exist or will be generated to operate and maintain in good repair a new transportation asset. This analysis shall be also be submitted to the board, advisory board, and board of directors of the department of transportation. If a project for the expansion of mass transit has a projected total cost in excess of $200,000,000, the authority shall submit the analysis to the secretary of administration and finance for a determination as to which costs, if any, will become part of the commonwealth’s plan of capital expenditures.



(c) Chapter 161B of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after section 8 the following section:-



Section 8A. Prior to the final approval of any capital project, and prior to expending any funds for the planning, design and construction of any such project, an authority shall prepare a fiscal analysis, including life cycle costs, demonstrating that sufficient revenues exist or will be generated to operate and maintain in good repair a new transportation asset.
