An Act relative to the oversight of inspections.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 3 of chapter 22, as so appearing in the 2010 Official Edition, is hereby amended, in lines 2-4, by striking out the words “There shall be in the department a division of inspection as established by section four A, under the charge of a director to be known as the chief of inspections,” and inserting in place thereof, “There shall be in the department 3 divisions as established by section four A: (i) a division of building inspection (ii) a division of elevator inspection and (iii) a division of engineering inspection. Each division shall be under the charge of a chief who shall be appointed by the commissioner and who shall be a person of skill and experience in the fields of buildings, elevators and engineering respectively.”

SECTION 2. Section 4A of chapter 22 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended by striking out, in the title, after the words “Chapter 22: Section 4A.” the words “Division of inspection; chief of inspections” and inserting in place thereof, “Divisions of Inspection; chiefs of inspection.”

SECTION 3. Section 4A of chapter 22 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in lines 1-2, by striking out the words “There shall be within the department a division to be knows as the division of inspection,” and inserting in place thereof the words:- “There shall be within the department 3 divisions to be knows as the division of building inspection, the division of elevator inspection and the division of engineering inspection”

SECTION 4. Section 4A of chapter 22, as so appearing the in the General Laws, as appearing in the 2010 Official Edition, is hereby amended, in line 3, by inserting after the word “inspections” the words:- for each division.

SECTION 5. Section 4A of chapter 22, as so appearing in the 2010 Official Edition, is hereby amended, in line 4, by striking out the word “position” and inserting the word:- positions.

SECTION 6. Section 4A of chapter 22 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in lines 8-9, by striking out the words “who are employed by the division” and inserting the words:- in each of the divisions.

SECTION 7. Section 4A of chapter 22 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 12, by inserting after the word “inspector” the words:- assigned to the division of building inspections and.

SECTION 8. Section 4A of chapter 22 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 18, by inserting after the words “on the application of any” the word: - building.

SECTION 9. Section 5 of chapter 22 of the General Laws, appearing in the 2010 Official Edition, is hereby repealed.

SECTION 10. Section 6 of chapter 22 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 5, by striking out the words:- and council.

SECTION 11. Section 6 of chapter 22 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended by striking out, in line 7-9, the words “Inspectors assigned to the division of inspection shall be designated as building inspectors or as district engineering inspectors according as their duties relate to buildings or engineering.”” and inserting in place thereof the words:-“Inspectors assigned to the division of building inspection shall be designated as building inspectors. Inspectors assigned to the division of elevator inspection shall be designated as elevator inspectors. Inspectors assigned to the division of engineering inspection shall be designated as district engineering inspectors.

SECTION 12. Section 10 of chapter 22 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 2 , by inserting after the words “chief of” the word:- engineering.

SECTION 13. Section 10 of chapter 22 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 3, by inserting after the words “division of” the word:- engineering.

SECTION 14. Section 10 of chapter 22 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 2, by striking the words “a boiler” and inserting in place thereof the word:- an.

SECTION 15. Section 11 of chapter 22 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 5, by inserting after the words “chief of” the word:- elevator.

SECTION 16. Section 50 of chapter 143 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended by inserting , following the words “chief of” in the title, the word:-building.

SECTION 17. Section 50 of the chapter 143 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 2, by striking out the words “chief of inspections of the department” and inserting in place thereof the words;- chief of building inspections.

SECTION 18. Section 93 of chapter 143 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 7, by inserting, following the words “the chief of” the word:- building.

SECTION 19. Section 93 of chapter 143 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 7, by inserting, following the words “division of” the word:- building.

SECTION 20. Section 93 of chapter 143 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 44, by striking out the words “the chief of inspections” and inserting in place thereof the following words:- chief of building inspections.

SECTION 21. Section 94 of chapter 143 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 53, by striking out the words “the chief of inspections” and inserting in place thereof the following words:- chief of building inspections.

SECTION 22. Section 1 of chapter 146 of the General Laws, as so appearing in the 2010 Official Edition, is hereby further amended, in line 13 by striking out the words “chief of inspections and inserting in its place thereof the following words:- chief of the division of engineering inspections.

SECTION 23. Section 1 of chapter 146 of the General Laws, as so appearing in the 2010 Official Edition, is hereby further amended, in line 16, by striking out the words “division of inspection” and inserting in place thereof the following words:- division of engineering inspection.

SECTION 24. Section 1 of chapter 146 of the General Laws, as so appearing in the 2010 Official Edition, is hereby further amended, in line 17 by inserting after the words “division of” the word:- engineering.

SECTION 25 Section 13 of chapter 146 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 7 by striking out the words “of inspection.”

SECTION 26. Section 49 of chapter 146 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 43, by striking the word “inspector.”

SECTION 27. Section 63 of chapter 146 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 3, by striking the word ”five” and inserting in place thereof the word:- three.

SECTION 28. Section 66 of chapter 146 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 4, by inserting after the words “inspectors of the” the word: “engineering” and by striking the word “chief” and inserting in place thereof the word:- commissioner.

SECTION 29. Section 10G of chapter 148 of the General Laws, as so appearing in the 2010 Official Edition, is hereby amended, in line 8, by striking the words “chief of inspections of the department” and inserting in place thereof the following words:- chief of engineering inspections.

SECTION 30. Section 18 ½ of chapter 6A of the General Laws, as so appearing in the 2010 Official Edition is hereby amended, in line 9, by striking out the words “the department of inspection and regulation.”

SECTION 31. Section 18 ½ of chapter 6A of the General Laws, as so appearing in the 2010 Official Edition is hereby amended, in lines 14-15, by striking the words “the division of inspection and the architectural access board” and interesting in place thereof the following words:- and the department of public safety.

SECTION 32. Section 50 of chapter 30 of the General Laws, as so appearing in the 2010 Official Edition is hereby amended, in line 7, by striking out the words “division of inspections” and inserting in place thereof the words:- division of engineering inspection.

SECTION 33. Section 51 of chapter 111 of the General Laws, as so appear in the 2010 Official Edition is hereby amended, in line 90, by inserting after the words “division of” the word:- building.

SECTION 34. Section 51 of chapter 111 of the General Laws, as so appearing in the 2010 Official Edition is hereby amended, in line 95, by inserting after the words “division of” the word:- building.

SECTION 35. Section 71 of chapter 111 of the General Laws, as so appearing in the 2010 Official Edition is hereby amended, in line 90, by inserting after the words “division of” the word:- building.

SECTION 36. Section 71 of chapter 111 of the General Laws, as so appearing in the 2010 Official Edition is hereby amended, in line 98, by inserting after the words “division of” the word:- building.

SECTION 37. Section 205A of chapter 140 of the General Laws, as so appearing in the 2010 Official Edition is hereby amended, in lines 36-37, by striking the words “division of inspection” and inserting in place thereof the words:- department of public safety.

SECTION 38. Section 205A of chapter 140 of the General Laws, as so appearing in the 2010 Official Edition is hereby amended, in line 55, by striking the words “division of inspection” and inserting in place thereof the words:- department of public safety.

SECTION 39. Section 1 of chapter 143 of the General Laws, as so appearing in the 2010 Official Edition is hereby amended, in line 17, by inserting after the words “division of” the word:- building.

SECTION 40. Section 13 of chapter 143 of the General Laws, as so appearing in the 2010 Official Edition is hereby amended, in line 1, by inserting after the words “division of” the word:- building.

SECTION 41 Section 68 of chapter 143 of the General Laws, as so appearing in the 2010 Official Edition is hereby amended, in line 8, by inserting after the words “division of” the word:- elevator.
