SECTION 1. Pursuant to chapter 86 of the acts of 1994, the Commonwealth of Massachusetts, acting through the division of capital planning and operations, conveyed portions of the Northampton State Hospital to Hospital Hill Development LLC, a Delaware limited liability company, c/o Massachusetts Development Finance Agency, 160 Federal Street, Boston, Massachusetts 02110, for the redevelopment of such portions of the Northampton State Hospital in accordance with chapter 86 of the acts of 1994. The division of capital planning and operations is now named the division of capital asset management and maintenance.
SECTION 2. Notwithstanding sections 40E to 40J, inclusive, of chapter 7 of the General Laws or any other general or special law to the contrary, pursuant to the express authority in chapter 86 of the acts of 1994, the commissioner of capital asset management and maintenance, in consultation with the commissioner of mental health, is hereby authorized to convey by deed, or to lease for a period not to exceed ninety-nine years, to Hospital Hill Development LLC, for nominal consideration that certain parcel of land comprising a part of the Northampton State Hospital located on the parcel known as the “Haskell Building Parcel” and comprising approximately 18,000 square feet as shown on a plan dated April 3,2012 and prepared by Arrowstreet Architects and held in the offices of the division of capital asset management and maintenance. The exact size and boundaries of the land to be conveyed shall be determined by the commissioner of capital asset management and maintenance, in consultation with the secretary of health and human services, the commissioner of mental health and Hospital Hill Development LLC, after completion of a survey.
SECTION 3. The commissioner of capital asset management and maintenance, acting in consultation with the commissioner of the department of mental health, shall prepare the necessary documents to convey the property described in section 2 to Hospital Hill Development LLC. Hospital Hill Development LLC shall be responsible for all costs including, without limitation, recording fees, to effect the transactions contemplated by section 2.
SECTION 4. This act shall take effect upon its passage.
