An Act authorizing the town of Belchertown to convey certain land.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 2 of chapter 353 of the acts of 1996 is hereby repealed.

SECTION 2. Said chapter 353 is hereby further amended by striking out section 3 and inserting in place thereof the following section:-

   Section 3.  Notwithstanding sections 32 to 37, inclusive, of chapter 7C of the General Laws or any other general or special law to the contrary, the commissioner may sell to the corporation, any interest that has not been otherwise conveyed as of the effective date of this section in parcels A, B, C, D, E and F as those parcels are shown on 2 plans of land, 1 of which is entitled “Plan of Land in Belchertown, Massachusetts prepared for the Commonwealth of Massachusetts Division of Capital Asset Management” prepared by E.B. Holmberg & Associates and dated April 9, 2002 and recorded with the Hampshire district registry of deeds in plan book 192, page 20 and 1 of which is entitled “Plan of Land in Belchertown, Massachusetts prepared for Commonwealth of Massachusetts Division of Capital Planning and Operations” prepared by E.B. Holmberg & Associates and dated May 2, 1996 and recorded with the Hampshire district registry of deeds in plan book 181, page 240, or any portions thereof and facilities thereon, on such terms and conditions as the commissioner deems appropriate.

SECTION 3.  Section 9 of said chapter 353 is hereby repealed.

SECTION 4. Notwithstanding chapter 30B of the General Laws or any other general or special law to the contrary, the town of Belchertown may transfer the care, custody, management and control of a certain parcel of land from the board of selectman and the conservation commission, acquired for conservation and passive recreation purposes, to the board of selectman for conveyance to Roland A. Leclerc.  In consideration for the conveyance, Roland A. Leclerc shall pay to the town the amount of $7,000.  The parcel, shown as "Parcel A" on a plan of land entitled "Plan of Land in Belchertown, MA Prepared for Roland Leclerc," dated October 15, 2010 and recorded with the Hampshire district registry of deeds in plan book 225, page 82 and containing 0.584 acres, more or less, according to the plan, was inadvertently included in the deed from Roland A. Leclerc to the town on June 27, 2011 and recorded in the Hampshire district registry of deeds in book 10587, page 250.

SECTION 5. This act shall take effect upon its passage.
