An Act authorizing the city of Gardner to convey certain land to New England Power Company.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  The City of Gardner is hereby authorized to sell and convey the property described below with the buildings and improvements thereon, if any, free from any restriction on said parcels for their use as conservation land, to the New England Power Company, for the use by New England Power Company for the installation of an electrical sub-station, the consideration for such sale and conveyance shall be twenty five thousand dollars.  Said parcel being bounded and described as follows:

Beginning at a point on the easterly side of former railroad right of way now or formerly owned by New England Power Company at the north westerly corner of City of Gardner cemetery property.   Thence N 21° 45’ 28” W a distance of 196.81 feet to a point of curvature to the right.  Thence 54.77 feet along the curve of radius 2823.54 feet to a corner.  Thence N 74° 47’ 11” E a distance of 250.00 feet to a corner.  Thence S 21° 38’ 13” E a distance of 251.57 feet to a corner.  Thence S 74° 47’ 11” W along the northerly boundary of said cemetery a distance of 250.00 feet to the point of beginning.  This parcel is comprised of approximately 62,556 square feet.

SECTION 2.  The City of Gardner shall record a deed with the Worcester District Registry of Deeds transferring 5.18 acres of land, more or less, to the care, custody, management, and control of the City of Gardner Conservation Commission.  Said parcel being bounded and described as follows:

Beginning 250’ from a drill hole in a stone wall at the northwesterly corner of the existing cemetery and adjacent to the former railroad right of way.  Thence N 15°- 35’- 49” W a distance of 377.83 feet to a corner; thence N 83°-37’-11” E a distance of 570.87 feet to an iron pipe; thence S 06°-22’-49” E a distance of 751.98 feet to a corner; thence N 21°-42’-49” W a distance of 204.28 feet to an iron pipe; thence   S 74°-47’-11” W a distance of 169.95 feet to a corner; thence N 21°-38’-13” W a distance of 251.57 feet to a corner; thence S 74°-47’-11” W a distance of 223.53 feet to the point of beginning.  Said parcel contains approximately 252,065 square feet or 5.787 acres. 

Excepting from the above, a parcel entitled “Revised Plan of Expansion of Crystal Lake Cemetery prepared for the City of Gardner, Gardner, MA” by Szoc Surveyors, dated November 10, 1999, and other land already incorporated into expansion of the existing cemetery, both described as follows:  Beginning at the south easterly corner at a stone post along the easterly line of the Crystal Lake Cemetery.  Thence S 87°-40’-00” W a distance of 104.59 feet to a granite bound; thence N 31°-16’-31” E a distance of 180.00 feet to a granite bound; thence S 89°-27’-09” E a distance of 83.75 feet to a granite bound; thence S 06°-30’-00” W a distance of 353.02 feet to a point; thence N 85°-00’-00” W a distance of 1.35 feet to a corner; thence N 08°-50’-00” W a distance of 204.28 feet to the point of beginning.  Said parcel contains approximately 23,813 square feet or 0.547 acres.

SECTION 3.  This act shall take effect upon its passage.
