An Act further regulating tanning facilities.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 207 of chapter 111 of the General Laws, as appearing in the 2012 Official Edition, is amended by inserting after the definition for “Board”, in line 8, the following definition: -

“Operator”, a person employed and trained by the licensee to control the operation of a tanning device in compliance with this section and sections 208 to 213, inclusive, and to assist and instruct the public in the correct operation of the tanning facility and its equipment.

SECTION 2.  Section 210 of said chapter 111, as so appearing, is hereby amended by adding the following sentence at the beginning thereof:-

No tanning facility shall employ a person under 18 years of age as an operator or permit an employee under 18 years of age to operate a tanning device. 

SECTION 3.  Said chapter 111 is hereby further amended by striking out section 211, as so appearing, and inserting in place thereof the following section:-

Section 211.  No person under 16 years of age shall use a tanning device except upon the written order of a physician.

No person 16 years of age to 17 years of age, inclusive, shall use a tanning device unless accompanied by a parent or legal guardian.  The facility owner or operator must indicate that such parent or guardian has read and understood the warnings required under the provisions of section 209.  For every use of a tanning facility, the parent or legal guardian of such person must sign, at the tanning facility and in the presence of the tanning facility owner or operator, the written consent form required in section 209.
