An Act authorizing the Massachusetts Highway Department to grant certain easements in the town of Petersham.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to forthwith the benefit of the town in order to provide handicap access improvements, therefore, it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. The Massachusetts Department of Transportation Highway Division is authorized to convey or transfer of, and/or grant and easement in and over, a portion of land within the route 32 right of way, directly abutting the property located at and known as 1-3 South Main Street next to the Town Offices and Town Hall to the care, custody and control of the town of Petersham.  The easements in said location are to be used for the construction, repairs and/or upgrade to the handicapped access ways to Petersham Town Offices.

SECTION 2. No deed conveying, by or on behalf of the commonwealth, the easements described in section 1 will be valid unless such deed provides that said easements will be used solely for the purposes described in section 1.

SECTION 3.  The grantee of said easement, or other persons acting on behalf of grantee, will assume the cost of any appraisals, surveys and other expenses deemed necessary by the commissioner of the division of capital asset management and maintenance for the granting of the easement.

SECTION 4. The town of Petersham will compensate the commonwealth through the transfer of this land, of equal or greater value to the easement described in section 1, to the Massachusetts Department of Transportation Highway Division.
