An Act relative to the pronouncement of death in a rest home..
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 9 of chapter 46 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after the word “home” , in line 22, the following words:- or licensed rest home;
SECTION 2. Said section 9 of said chapter 46, as so appearing, is hereby further amended by striking out, in line 23, the words “a nursing” and inserting in place thereof the following words:- at such nursing or rest home;
SECTION 3. Said section 9 of said chapter 46, as so appearing, is hereby further amended by striking out, in line 25, the words “or nursing home” and inserting in place thereof the following words:- , nursing home or licensed rest home.”
SECTION 4. Said section 9 of said chapter 46, as so appearing, is hereby further amended by striking out, in lines 31 through 33, the words “and provided, further, that said physician or medical examiner be notified forthwith of the exact location to which the decedent has been removed” and inserting in place thereof the following words:- “provided, further, that said physician or medical examiner be notified forthwith of the exact location to which the decedent has been removed; and provided, further, that when pronouncing death in a licensed rest home, the time spent pronouncing death shall not count toward the number of hours per month per unit required by the department of public health for a licensed consultant nurse.
