An Act allowing certain senior support staff members of Protection Fire Co. No. 1 Byfield, Massachusetts to continue to serve beyond the age of 65.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Notwithstanding any general or special law to the contrary, Robert Haynes, Wayne Reetz and Edward Stearns, designated as “Senior Support Staff”, who are members of Protection Fire Co. No. 1 Byfield, Massachusetts; may continue to serve in that capacity past the age of 65, until the date of retirement or until the date he or she is relieved of his or her duties by the Board of Fire Engineers, whichever occurs first; provided, however, that he or she is mentally and physically capable of performing the duties of his office. The Board of Selectmen of the Town of Newbury may require such individuals be examined, at their own expense, by an impartial physician designated by the board to determine his or her mental and physical capability. No further deductions shall be made from the regular compensation of such individuals under chapter 32 of the General Laws for any service subsequent to the date such individual turns 65 years old, and upon retirement, he or she shall receive a superannuation retirement allowance equal to that which he would have been entitled had he retired at 65.
