An Act relative to the protection of propane gas ratepayers.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 93 of the general laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after section 94, the following new section: -
Section 94A. (a) For purposes of this section the term “automatic renewal contract” shall mean any contract or agreement between a propane gas dealer and ratepayer upon the expiration of which said dealer may automatically reauthorize and execute the terms contained therein.
(b) In the case of an automatic renewal contract for the sale of propane at a variable rate, the propane gas dealer shall notify the ratepayer of any increase in the propane gas rate that is equal to or greater than ten percent of the rate charged at the time of the previous delivery. Said propone gas dealer shall deliver said notice in writing, at least fifteen days before the next scheduled delivery.
