An Act relative to domestic abuse.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 34C of Chapter 208, of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting at end of the first paragraph the following paragraph:-
If the defendant is over the age of sixty five and has been ordered to vacate the marital home; no order shall be for more than thirty days and no extension thereof shall be heard or issued by any probate judge. Any Extension shall be heard only by motion of the original petitioner, and not by any advocate or other person and shall be filed in the Superior Court and shall be heard by a superior court judge in the county or an adjoining county of where the original order to vacate the martial home issued.
