An Act providing municipal control of liquor licenses.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

                 SECTION 1. Chapter 138 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by striking out section 17 and inserting in place thereof the following section:-

                 Section 17. The legislative body of each city or town that has voted to grant licenses for the sale of alcoholic beverages as provided in section 11 shall determine the number of licenses issued in the city or town under sections 12 and 15. Cities or towns that have voted to grant licenses as provided in section 11 may grant seasonal licenses under section 12 in a number determined by the legislative body. Cities or towns that have voted to grant licenses as provided in section 11 may grant licenses under sections 12, 15 or 15F to the holder of a farmer-winery license under section 19B in a number determined by the legislative body.

                SECTION 2. Sections 17A, 7B and 17C of said chapter 138 are hereby repealed.

                SECTION 3. The number of licenses for the sale of alcoholic beverages allowed by prior law shall continue in force until changed by the legislative body under section 17 of chapter 138 of the General Laws.
