An Act regarding document preparation fees for motor vehicle sales.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Chapter 255B of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting the following additional section:-

Section 26. In addition to a finance charge as provided in Section 14 of this chapter, a dealer may only charge a purchaser of a vehicle one fee associated with all preparation and processing of documents, hereinafter referred to as the “Document Preparation Service Fee,” related to the purchase.  The Document Preparation Service Fee shall include but not be limited to: the preparation of the sales contract and all documents related to the sales contract; the preparation of the financing application and all documents related to the financing of the vehicle; the preparation and processing of all necessary certificates related to the vehicle purchase; the preparation and processing of all documents  necessary to issue or transfer a certificate of title for a vehicle or register a vehicle or transfer registration of a vehicle; and any other preparation or processing of documents related to the completion of the vehicle sales and finance transaction. The dealer shall not represent the Document Preparation Service Fee as a governmental fee or one required by government, and the total Document Preparation Service Fee shall not exceed $75.00.
