An Act authorizing the city of Newburyport to impose liens upon properties in the town of Newbury which connect to the water and sewer systems of the city.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, the city of Newburyport may impose a lien upon any property in the town of Newbury which is or shall be connected to the water and/or sewer systems of the City of Newburyport pursuant to an agreement or agreements, past or future, between the city of Newburyport and the town of Newbury, which lien shall secure unpaid fees and charges relative to connection to or use of the water and/or sewer systems of the city of Newburyport. If a charge or fee secured by such lien remains unpaid when the town of Newbury assessor is preparing a real estate tax list and warrant, upon request by the city of Newburyport, the charge or fee and any interest and costs incurred by the city may be added to the tax on such property pursuant to section 58 and chapter 40 of the General Laws. Upon receipt of tax payments which include a charge or fee imposed pursuant to such agreement between the city of Newburyport and the town of Newbury, the town of Newbury shall forthwith transfer such charge or fee payment and any interest and costs incurred by the city to the city of Newburyport.
SECTION 2. This act shall take effect upon its passage.
