An Act relative to out-of-state contractors and sub-contractors.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 149 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after section 44M the following section:-
44N. Notwithstanding any general or special law to the contrary, no construction contract awarded by a public entity, or sub-contract awarded in furtherance of such contract, shall be awarded to a person, corporation, or other organization or partnership that is headquartered outside of Massachusetts unless it can be demonstrated that no Massachusetts party is equipped to provide the services required under the proposed contract or sub-contract.
