Mr. Tarr moved that the bill be amended by striking lines 4-7, inclusive, and inserting in place thereof the following:-

“In an action brought by an owner or mortgagee holding a recorded first mortgage to enforce this subsection, the owner or mortgagee shall be entitled to monetary damages against the organization of unit owners of not more than $100 per day for each day that the organization of unit owners failed to comply with this subsection. In addition to any such monetary damages imposed, the organization of unit owners may be responsible for all reasonable attorneys’ fees incurred by the owner or mortgagee in bringing the action.”
