SECTION 39. Section 5-101 of Chapter 190B of the General Laws, as so appearing, is hereby amended by striking out paragraph (12) in its entirety.

SECTION 40. Section 5-101 of said Chapter 190B of the General Laws, as so appearing, is hereby amended by inserting, after paragraph 18, the following:-

(18A) “Person with a developmental disability”, an individual who has a substantial limitation in present functioning beginning before age 18, manifested by significantly subaverage intellectual functioning existing concurrently with related limitations in 2 or more of the following applicable adaptive skills areas: communication, self-care, home living, social skills, community use, self-direction, health and safety, functioning academics, leisure, and work.

SECTION 41. Section 5-304 of said Chapter 190B of the General Laws, as so appearing, is hereby amended by striking out, in each instance, the phrase “mentally retarded” and inserting in place thereof the following:- developmentally disabled

SECTION 42. Section 5-309 of said Chapter 190B of the General Laws, as so appearing, is hereby amended by striking out, in each instance, the phrase “mental retardation” and inserting in place thereof the following:- developmental services

SECTION 43. Section 32 of Chapter 209 of the General Laws, as so appearing, is hereby amended by striking out, in each instance, the phrase “mental retardation” and inserting in place thereof the following:- developmental disability

SECTION 44. Section 85V of Chapter 231 of the General Laws, as so appearing, is hereby amended by striking out, in each instance, the phrase “mentally retarded” and inserting in place thereof the following:- people with developmental disabilities

SECTION 45. Section 23E of Chapter 233 of the General Laws, as so appearing, is hereby amended by striking out, in each instance, the phrase “mental retardation” and inserting in place thereof the following:- developmental disabilities

SECTION 46. Section 13F of Chapter 265  of the General Laws, as so appearing, is hereby amended by striking out, in each instance, the phrase “mentally retarded person” and inserting in place thereof the following:- person with a developmental disability

SECTION 47. Section 45 of said Chapter 265 of the General Laws, as so appearing, is hereby amended by striking out, in each instance, the phrase “mentally retarded person” and inserting in place thereof the following:- person with a developmental disability

SECTION 48. Section 7 of Chapter 268A of the General Laws, as so appearing, is hereby amended by striking out, in each instance, the phrase “mentally retarded” and inserting in place thereof the following:- developmentally disabled

SECTION 49. Each agency in the executive branch shall amend its regulations to remove any instance of the words “retardation” or “retarded” in its regulations within 90 days of the effective date of this act.
