An Act relative to animal abuse.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 112 of Chapter 266 of the General Laws, as amended by Section 2 of Chapter 293 of the Acts of 2014, is further amended by striking out, "7 years in state prison or imprisonment in the house of correction for not more than 2 1/2 years or by a fine of not more than $5,000 or by both fine and imprisonment; provided, however, that a second or subsequent offense shall be punished by imprisonment in the state prison for not more than 10 years or by a fine of not more than $10,000 or by both such fine and imprisonment" and inserting in place thereof the following words: - 10 years in a state prison or house of correction with a fine of not more than $5,000, however, that subsequent offenses shall be punished by imprisonment in the state prison for not more then 15 years and a fine of not more than $15,000.

SECTION 2. Section 77 of chapter 272 of the general laws, as amended by Section 3 of Chapter 293 of the Acts of 2014, is further amended by striking out, "7 years in state prison or imprisonment in the house of correction for not more than 2 1/2 years or by a fine of not more than $5,000 or by both fine and imprisonment; provided, however, that a second or subsequent offense shall be punished by imprisonment in the state prison for not more than 10 years or by a fine of not more than $10,000 or by both such fine and imprisonment" and inserting in place thereof the following words: - 10 years in a state prison or house of correction with a fine of not more than $5,000 provided, however, that subsequent offenses shall be punished by imprisonment in the state prison for not more then 15 years and a fine of not more than $15,000.
