An Act requiring blood testing for surviving drivers.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 24 of chapter 90 of the General Laws, as recently amended by sections 98, 99 and 100 of chapter 139 of the Acts of 2012, is hereby further amended by inserting after the word “liquor”, in line 505, the following words:- or involved in any motor vehicle accident or collision resulting in personal injury or death.
SECTION 2. Section 24 of said chapter 90, as recently amended, is hereby further amended by striking out, in line 513, the word “arrested”.
SECTION 3. Section 24 of said chapter 90, as recently amended, is hereby further amended by inserting after the word “liquor”, in line 515, the following words:- or during any motor vehicle accident or collision resulting in personal injury or death.
SECTION 4. Section 24 of said chapter 90, as recently amended, is hereby further amended by striking out, in line 515, the word “arrested”.
SECTION 5. Section 24 of said chapter 90, as recently amended, is hereby further amended by striking out, in lines 519 and 520, the words “no such test or analysis shall be made and”.
SECTION 6. Section 24 of said chapter 90, as recently amended, is hereby further amended by striking out, in line 515, the word “and”.
SECTION 7. Section 24 of said chapter 90, as recently amended, is hereby further amended by inserting after the word “operator”, in line 554, the following words:- ; and (iv) proceed in administering the test or analysis of his blood pursuant to this section.
SECTION 8. Section 24 of said chapter 90, as recently amended, is hereby further amended by striking out, in line 560, the word “arrested”.
SECTION 9. Section 24 of said chapter 90, as recently amended, is hereby further amended by inserting after the word “liquor”, in line 561, the following words: - or during any motor vehicle accident or collision resulting in personal injury or death.
SECTION 10. Section 24 of said chapter 90, as recently amended, is hereby further amended by striking out, in line 606, the word “arrested”.
SECTION 11. Section 24 of said chapter 90, as recently amended, is hereby further amended by inserting after the word “liquor”, in line 607, the following words: - or during any motor vehicle accident or collision resulting in personal injury or death.
SECTION 12. Section 24 of said chapter 90, as recently amended, is hereby further amended by striking out, in lines 642 and 643, the word “arrested”.
SECTION 13. Section 24 of said chapter 90, as recently amended, is hereby further amended by inserting after the word “liquor”, in line 644, the following words: - or during any motor vehicle accident or collision resulting in personal injury or death.
SECTION 14. Section 24 of said chapter 90, as recently amended, is hereby further amended by inserting after the word “arrest”, in line 645, the following words: -or motor vehicle accident or collision.
SECTION 15. Section 24 of said chapter 90, as recently amended, is hereby further amended by inserting after the word “liquor”, in line 666, the following words: - or during any motor vehicle accident or collision resulting in personal injury or death.
