An Act to add Law Enforcement Councils to the Massachusetts Tort Claims Act.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

WHEREAS, Chapter 40, § 4J of the General Laws authorizes the establishment of  “Law Enforcement Councils,” as nonprofit corporations comprised of municipal police chiefs and other law enforcement agencies to provide mutual aid to its members and enhanced public safety by otherwise sharing resources and personnel, and;

WHEREAS, such Law Enforcement Councils, being comprised of police chiefs and other law enforcement agencies, may be established to carry out the police powers of its members, and;

WHEREAS, the deferred operation of this act would tend to defeat its purpose, which is to expressly include such Law Enforcement Councils within the indemnity protections of General Laws, chapter 258;

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

Section 1: Section 1 of chapter 258 of the General Laws, as so appearing, is hereby amended by inserting after the word “including”, in line 40, the following words, “any Law Enforcement Council established pursuant to section 4J of chapter 40 and."
