Section 1. Section 123 of Chapter 266 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by adding the following section:-
“Whoever knowingly, willfully, or wantonly trespasses upon a state highway without just cause shall be punished by a fine of not less than five thousand dollars or by imprisonment for not more than 6 months. Just cause shall include but not be limited to a disabled vehicle or medical emergency. If such trespassing prevents a patient in need of medical treatment from getting such medical treatment, the punishment shall increase to not less than seven thousand dollars or by imprisonment for not more than a year. If such trespassing interferes with a patient in need of medical treatment and said patient in need of medical treatment dies by reason of such trespassing, the punishment shall be a fine of ten thousand dollars, or by imprisonment in a jail or house of correction for not more than two and one half years or in the state prison for not more than five years, or both.”
