By Ms. Malia of Boston, a petition (accompanied by bill, House, No. 1810) of Elizabeth A. Malia and others for legislation to mandate coverage for telemedicine behavioral health services in circumstances when office visits are not practical.  Mental Health and Substance Abuse.

An Act relative to behavioral health telemedicine.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 118E of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after section 10G the following new section:-

“Section 10H. The division shall provide coverage for telemedicine behavioral health services in circumstances where geography, specialty or linguistic and cultural capacity dictates that in office visits are not within a reasonable distance.”

SECTION 2. Section 47BB of chapter 175 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after paragraph (a) the following new paragraph:-

“(b) An insurer shall cover telemedicine behavioral health services in circumstances where geography, specialty or linguistic or cultural capacity dictates that in office visits are not within a reasonable distance.”
