In the One Hundred and Eighty-Ninth General Court

An Act to protect residential building lots.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 6 of Chapter 40A of the General Laws shall be amended as follows:

SECTION 1:  By deleting paragraph three and inserting in its place the following:

”Except for lots zoned for single and two family residential family use, a zoning ordinance or by-law may define and regulate nonconforming uses and structures abandoned or not used for a period of two years or more. “

SECTION 2: By adding at the beginning of the first line of paragraph 4 the following words:

“Notwithstanding the previous existence of any building or structure thereon,”
