Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.

Section 54B of chapter 71 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after the fourth paragraph the following:—

Notwithstanding any general or special law or regulation to the contrary, a school district shall allow a parent or legal guardian of any child to expressly authorize the school department and school bus drivers, licensed pursuant to section 8A of chapter 90, to administer epinephrine, by means of an epinephrine auto-injector, to his or her child in the case of an allergic emergency.
