An Act adopting administrative simplification for hospital pharmacists.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 1:  Section 21 of Chapter 94C of the general laws, as most recently inserted by Section 6 of Chapter 159 of the Acts of 2014, is hereby amended by striking the last sentence in its entirety and inserting in place thereof the following:-  “This section shall not apply to an institutional pharmacy licensed pursuant to section 39I of chapter 112 if the sterile drug preparation compounded by such pharmacy is to be administered to an individual who is receiving active care and treatment within the institution.”

Section 2:  Clause (6) of subsection (a) of Section 39Iof Chapter 112 of the general laws, as inserted by Section 18 of Chapter 159 of the Acts of 2014, is hereby amended by inserting after the word “preparations.” at the end thereof the following new sentence:-“The provisions of this subsection shall not apply to prescriptions that are administered to an individual who is receiving active care and treatment within the institution.”
