An Act relative to health care access.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Subsection (e) of section 6 of chapter 64H of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by adding the following:- 

; provided, however, that a corporation, foundation, organization or institution that is licensed as a hospital or a health care provider pursuant to chapter 111 of the general laws shall not be entitled to an exemption certification unless during the most recent year for which information is available, the sum of its MassHealth revenue and cost of free care is equal to or greater than ten percent of its gross patient service revenue.  Such corporation, foundation, organization or institution shall annually report to the commissioner the total revenue it derives from MassHealth and the total cost of free care it reports to the Attorney General, the department of public health and to the Center for Health Information Analysis, on a form prescribed by said commissioner.  The commissioner shall promulgate regulations to administer this requirement.
