SECTION 1. Notwithstanding sections 33 through 37, inclusive, of Chapter 7C of the General Laws or any general or special law to the contrary, including, without limitation section 20 of chapter 304 of the acts of 2008, the commissioner of capital asset management and maintenance shall convey a certain parcel of state-owned land with the buildings thereon located in the City of Salem to the Salem Redevelopment Authority on such terms as may be determined by the commissioner. Said parcel and buildings are located at 32 and 34 Federal Street and are commonly known as the Salem Superior Courthouse and County Commissioners Building, respectively.
SECTION 2. As consideration for the conveyance described in section 1, the Salem Redevelopment Authority shall pay $1.00 at the time of the conveyance. Upon any subsequent sale of the property or any portion thereof by the Salem Redevelopment Authority, the Salem Redevelopment Authority shall distribute the gross proceeds of such sale (i) first, to the Commonwealth to reimburse it for costs incurred by the division of capital asset management and maintenance with respect to the properties described in section 1, (ii) next, to the city of Salem for costs incurred by the city with respect to the properties described in section 1, (iii) next, to the Salem Redevelopment Authority for costs incurred by the Salem Redevelopment Authority , if any, for the transaction, including without limitation, all costs for legal work, survey, title and the preparation of plans and specifications, and (iv) in equal shares to the commonwealth and the Salem Redevelopment Authority.
SECTION 3. The commissioner of capital asset management and maintenance may retain or grant rights of way or easements for access, egress, utilities and drainage across the property described in section 1 and across other commonwealth property contiguous to the property described in section 1, and may accept such rights of way or easements for access, egress, drainage and utilities as the commissioner considers necessary and appropriate to carry out this act.
