By Mr. Arciero of Westford, a petition (accompanied by bill, House, No. 2936) of James Arciero, Angela Harknes and Dr. Mitchell Sweet for legislation to authorize the Registrar of Motor Vehicles to issue new titles on vehicles that lien holders on an existing title have proven to be no longer in existence.  Transportation.

An Act relative to non-existent lien holder of motor vehicles.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1

Section 2 of chapter 90 of the general laws is hereby amended, by adding at the end thereof, the following new paragraph:-

Notwithstanding any other law to the contrary, the registrar of motor vehicles shall have the authority to issue a new title on any vehicle in the event that a lien holder on an existing title has been proven to be no longer in existence.  The registrar shall, upon making such a determination, issue a new title free of the original lien.  In the event that a lien holder fails to return an original title to the registry of motor vehicles in order for the vehicle to be transferred subject to said lien, then the registrar of motor vehicles shall have the authority to issue a new title on said vehicle with said lien noted thereupon.     The registry of motor vehicles shall promulgate regulations to effect the provisions of this paragraph.
