An Act relative to clarity and truthfulness in direct mailings.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Chapter 93A of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by adding the following section:-

Section 12. (a) It shall be an unfair trade practice and therefor unlawful for any person using the United States mail to deliver an offer of air travel and refuse to disclose the name of the business entity sending the offer in clear and legible writing, by naming the actual company or agency the recipient of the offer may contact along with the specific purpose of the mailing.  Any such mailing shall be trade or commerce as defined in this chapter.

(b) No such mailing shall include a statement that other restrictions apply without specifically setting forth in writing, in the mailing, a detailed description of the specific restriction that applies printed clearly in a font of at least 10-point in size.
