An Act relative to historical preservation organizations.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 231 of the General Laws is hereby amended by inserting after section 85AA, as appearing in the 2012 Official Edition, the following section :-
Section 85BB. (a) For purposes of this section, the term “historical preservation organization” shall mean a nonprofit corporation, trust or association located in the commonwealth that is operated primarily for historical preservation purposes and owns or cares for real property of historical significance exhibited to the public.
(b) A historical preservation organization, or any trustee, employee or other agent thereof, shall not be liable in any suit for damages suffered by any guest, customer, licensee, invitee, employee or other person for any act or omission relative to the control or operation of any real property of historical significance being exhibited to the public, unless such act or omission constitutes willful, wanton or reckless conduct.
