Chapter 114 of the General Laws is hereby amended by adding the following section:-
Section 52. (a) The department of public health shall establish a mandatory registration program for any person who holds himself or herself out as providing cremation services for non-human animal remains, hereinafter referred to as a pet crematorium. No pet crematorium shall provide cremation services without first receiving a registration from the department.
(b) A pet crematorium shall maintain digital video footage of each individual animal cremation. Such footage shall allow for the clear identification of the animal remains immediately prior to their being subject to cremation and include a clear, uninterrupted image of the removal of the remains immediately following the cremation. The footage shall include a date and time stamp and must be confidentially maintained by the pet crematorium for no less than 2 years from the date of the cremation.
(c) A violation of subsection (b) shall be punishable by a fine of no more than $10,000, imprisonment in the house of correction for no more than 1 year, or both such fine and imprisonment. Each cremation in violation of subsection (b) shall be considered a separate violation.
