An Act relative to increasing special education circuit breaker and regional transportation reimbursement.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 3 of chapter 70 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after the word “allotment.” the following words:-

Additionally, cities, towns and districts shall receive extraordinary special education aid according to the following formula: School districts will receive eighty percent of all special education costs, including transportation costs, if the city, town, or district utilizes a regional transportation network to reduce transportation costs or other collaborative and demonstrated efforts to reduce such costs, above 3 times the per pupil foundation budget. Cities, towns and school districts will be eligible for extraordinary special education funding from the Commonwealth which will be distributed to cities, towns and districts in the budget year that the tuition is payable.

SECTION 2. Section 5A of chapter 71B of the General Laws, as so appearing, is hereby amended by striking out, in line 8, the word “not”.

SECTION 3. Said section 5A of said Chapter 71B of the General Laws, as so appearing, is hereby further amended by striking out, in lines 26 through 27, inclusive, the words:- “transportation costs”.

SECTION 4. Said section 5A of said chapter 71B of the General Laws, as so appearing, is hereby amended by striking out, in lines 44 and 51, the figure “4” and inserting in place thereof the following figure: 3.
