By Ms. Provost of Somerville, a petition (accompanied by bill, House, No. 3336) of Denise Provost, Timothy J. Toomey, Jr. and Christine P. Barber (with the approval of the mayor and city council) that the city of Somerville be authorized to issue sixty five additional licenses for the sale of alcoholic beverages.  Consumer Protection and Professional Licensure.  [Local Approval Received.]

An Act further regulating the sale of alcoholic beverages in the city of Somerville.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. The first sentence of the first paragraph of section 3 of chapter 381 of the acts of 2012 is hereby amended by striking out the words “12 additional licenses” and inserting in place thereof the following words: - 27 additional licenses.

SECTION 2. Notwithstanding section 17 of chapter 138 of the General Laws, chapter 381 of the acts of 2012, or any other general or specific law to the contrary, the licensing commission of the city of Somerville may grant up to 35 additional licenses for the sale of all alcoholic beverages to be drunk on the premises and up to 15 additional licenses for the sale of wine and malt beverages to be drunk on the premises under section 12 of said chapter 138. Said licenses shall be subject to all of said chapter 138, except said section 17. All licenses issues pursuant to this section shall be clearly marked “nontransferable” on the face of the license. If a licensee terminates of fails to renew its license, or if a license granted under this section is cancelled, revoked, or no longer in use, the license shall revert to the licensing commission of the city of Somerville, and shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, and may only be granted to a new, qualified applicant; provided, however, that such new applicant files with the commission a letter from the department of revenue indicated that the license is in good standing with the department and that all applicable taxes have been paid.

The administrative fee charged by the city of Somerville for such licenses shall be the same amount as the administrative fee charged by the city for existing licenses granted for the respective category for such licenses. The licenses granted under this section shall be subject to all applicable ordinances of the city.

SECTION 3. This act shall take effect upon its passage.
