To the Honorable Senate and House of Representatives,
Pursuant to Article LVI, as amended by Article XC, Section 3 of the Amendments to the Constitution of the Commonwealth of Massachusetts, I am returning to you for amendment House Bill No. 3183, “An Act Establishing a Sick Leave Bank for Daniel Cardillo, an Employee of the Division of Capital Asset Management and Maintenance.”
Sick leave banks are established to provide much needed relief to state employees who have exhausted all leave time due to serious medical challenges. Sick leave banks are funded by those employees’ generous colleagues, who contribute their own vacation, sick and/or personal time. In this case, we have learned that Mr. Cardillo has been able to re-enroll in the Extended Illness Leave Bank and, accordingly, does not have an immediate need for a sick leave bank.
I, therefore, recommend that House Bill No. 3183 be amended by striking the last paragraph and inserting in place thereof the following paragraph:-
“Notwithstanding any general or special law to the contrary, the division of capital asset management and maintenance shall establish a sick leave bank for Daniel Cardillo, an employee of the division. Any employee of the division may voluntarily contribute 1 or more sick, personal or vacation days to the sick leave bank for use by Daniel Cardillo. Upon exhaustion of all other available leave time including personal days, vacation days, sick time and any time available pursuant to the extended leave illness bank established by section 4P of chapter 7 of the General Laws, Mr Cardillo shall be permitted to use any time credited to the sick leave bank established by this act. Whenever Daniel Cardillo terminates employment with the division or requests to dissolve the sick leave bank, any remaining time in the sick leave bank shall be transferred to the extended illness leave bank established by section 4P of chapter 7 of the General Laws. Sick leave bank days shall not be used for absences unrelated to the illness or disability that necessitated the establishment of the sick leave bank as determined by the division.”
