An Act relative to equitable dental reimbursement rates for services provided to publicly aided patients.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Subsection (b) of section 16T of chapter 6A of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by adding the following paragraph:-

The plan shall provide for an index to the child and adult dental fee schedule to the seventy-fifth percentile of the most current American Dental Association Survey of Dental Fees of General Practitioners by January 1, 2016 for all MassHealth programs. The plan, at a minimum, shall include all dental services covered as of January 1, 2009.

SECTION 2. Chapter 118E of the General Laws, as so appearing, is hereby amended by striking out section 53 and inserting in place thereof the following section:-

Section 53. The division shall include within its covered services for adults all federally optional services that were included in its state plan or demonstration program in effect on January 1, 2002. Covered services for adults in the MassHealth Essential program shall include dental services to the same extent as such services were covered for adults in the MassHealth Basic program as of January 1, 2002; provided, however that the executive office shall develop a plan to index the child and adult dental fee schedule for all MassHealth programs to the seventy-fifth percentile of the most current American Dental Association Survey of Dental Fees of General Practitioners by January 1, 2016. The plan, at a minimum, shall include all child and adult dental services covered as of January 1, 2009.

To the extent permitted by the demonstration program approved under 42 U.S.C. section 1315(a), covered services in the MassHealth Basic and MassHealth Essential programs shall include hospice services to the extent such services are covered in the MassHealth Standard program.
