Stanley and others for legislation to expand the use of benefits granted with the issuance of special permits by a  municipality to areas throughout said municipality.  Municipalities and Regional Government.

An Act enhancing the utilization of certain mitigation funds.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 9 of chapter 40A of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after the second paragraph the following paragraph:-

Zoning ordinances or by-laws shall provide that the benefits of any improvements, amenities, funds or other conditions required for the granting of a special permit shall not be limited to use or application in only the immediate vicinity or zone of the development for which the special permit is required and that such benefits may be used throughout the municipality in which the special permit granting authority is located.
