An Act requiring municipalities to follow Occupational Safety and Health Act (OSHA) regulations and standards with regard to: trenching and excavation; and confined space work.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 149 of the General Laws is hereby amended by inserting after section 6G the following section:-
Section 6H. Notwithstanding any general or special law to the contrary the department shall adopt regulations that shall provide to employees of towns and cities, at a minimum, the same protections provided to employees under those portions of the federal Occupational Safety and Health Act, applicable federal regulations, and any other rules or regulations of the Occupational Safety and Health Administration that relate to trenching, excavation, and confined spaces. Such regulations shall also ensure that towns and cities comply with all relevant standards and requirements of those portions of the federal Occupational Safety and Health Act, applicable federal regulations, and any other rules or regulations of the Occupational Safety and Health Administration that relate to trenching, excavation, and confined spaces.
