An Act relative to protecting the electrical transmission grid system of Massachusetts.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
(a) Each electrical company, as defined in section 1 of chapter 164 of the General Laws, shall develop and implement a plan to address the vulnerability of the electrical transmission grid within its control to natural and nuclear electromagnetic pulses and other man-made and natural occurrences that may pose a threat to local, state or national security.
(b) A plan shall include, at a minimum: (1) a description of the electrical transmission grid within the electric company’s jurisdictional boundaries; (2) an analysis of potential man-made and naturally occurring short, medium and long-term threats to the electrical transmission grid; (3) the electric company’s plan for addressing such threats, including the anticipated costs of implementing those measures; (4) a time-table for implementation of protective measures based upon a prioritization of vulnerabilities; and (5) the means to ensure a minimum of 72 hours of back-up electrical supply to critical infrastructure within the electric company’s jurisdictional boundaries.
(c) Each plan shall be submitted to the adjutant general of the commonwealth, the director of the Massachusetts emergency management agency, and the department of public utilities on or before December 31, 2015, who shall review the plan and submit a joint report to the governor with their comments and recommendations on or before June 1, 2016. The governor shall then approve, conditionally approve or disapprove each plan on or before December 31, 2016.
(d) Neither a plan developed pursuant to this section nor a report prepared by the adjutant general of the commonwealth, the director of the Massachusetts emergency management agency, and the department of public utilities pursuant to subsection (c) shall be considered a public record or subject to disclosure.
(e) The adjutant general of the commonwealth, the director of the Massachusetts emergency management agency, and the department of public utilities shall: (1) develop agency action plans, which shall be consistent with the electrical company plans developed pursuant to this section as approved or conditionally approved by the governor; and (2) coordinate with their counterpart agencies, in those states connected to the commonwealth’s electrical transmission grid through a regional grid system, and the Federal Energy Regulatory Commission to develop a collaborative response to regional electrical transmission grid vulnerabilities.
