To the Honorable Senate and House of Representatives,
Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as appearing in Article LXXXIX of said Amendments, I am filing for your consideration the attached legislation entitled, “An Act Validating the Actions Taken at an Annual Town Meeting and Election Held in the Town of Essex.”
The Essex Board of Selectmen has requested that I file this special legislation on behalf of the Town of Essex.
The Town discovered on May 4, 2015 that it had not met certain statutory requirements regarding the posting of the warrant for the annual town meeting on the same day and annual town election on May 11, 2015. This legislation would validate the acts and votes taken at the meeting and election and all subsequent actions made as a result of those outcomes.

An Act validating the actions taken at an annual town meeting and election held in the town of Essex.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding section 9A and 10 of chapter 39 of the General Laws or any other general or special law or town by-law to the contrary, all acts, proceedings and votes taken by the town of Essex at its May 4, 2015 town meeting and May 11, 2015 annual town election, and all actions taken pursuant thereto and in reliance thereon, are hereby ratified, validated and confirmed to the same extent as if the town had complied with all statutory requirements for posting the warrant for such town meeting and election.
SECTION 2. This act shall take effect upon its passage.
